Der Lieferant bestätigt, dass er die Embargos, Sanktionen und das Außenhandelsrecht der Europäischen Union sowie der Vereinigten Staaten von Amerika, insbesondere die Verordnungen (EU) 833/2014 und (EG) 765/2006 (gemeinsam die „Vorschriften“) stets einhält.
Der Lieferant wird Wieland alle von Wieland angeforderten Informationen im Zusammenhang mit der Einhaltung der Vorschriften zur Verfügung stellen und Wieland insbesondere schriftlich nachweisen, dass a), sofern der Lieferant seinen Sitz außerhalb der Europäischen Union hat, für die Herstellung der Liefergegenstände keine Erzeugnisse aus Eisen und Stahl im Sinne der Verordnung (EU) 833/2014 Art. 3g Abs. 1d und deren Anhang XVII sowie der Verordnung (EG) 765/2006 Art. 1q und deren Anhang XII verwendet werden und b) der Lieferant keine Erzeugnisse aus Aluminium, Kupfer oder Nickel russischen oder belarussischen Ursprungs importiert, exportiert und im Zusammenhang mit der Herstellung der Liefergegenstände verwendet.
Verstößt der Lieferant gegen eine der in dieser Bestimmung genannten Verpflichtungen, kann Wieland den betroffenen und/oder andere Verträge mit dem Lieferanten mit sofortiger Wirkung kündigen.
Binding notes regarding our purchase orders
The supplier represents and warrants that supplier fully complies with any embargos, sanctions and foreign trade law in the European Union and the United States, in particular, but not limited to, Council Regulation (EU) 833/2014, Council Regulation (EG) 765/2006 (the “Regulations”).
The supplier shall provide Wieland with any information concerning supplier’s compliance with the regulations as reasonably requested by Wieland, in particular, but not limited to a) if supplier’s registered seat is outside of the European Union, the supplier shall provide Wieland with written evidence that no iron and steel products according to, Regulation (EU) 833/2014 Art. 3g para. 1 and its Annex XVII as well as Regulation (EG) 765/2006 Art. 1q and its Annex XII are used in the course of manufacturing deliverables to be supplied to Wieland and b) the supplier shall provide Wieland with written evidence that the supplier does not import, export or include in such deliverables any product containing aluminum, copper or nickel that are of Russian or Belarus origin.
If the supplier is in breach of any obligation set out in this provision, Wieland may terminate any affected and/or any other agreement(s) with the supplier with immediate effect.

O fornecedor declara e garante que cumpre integralmente quaisquer embargos, sanções e leis do comércio internacional na União Europeia e nos Estados Unidos, em particular o Regulamento (UE) n.º 833/2014 do Conselho e o Regulamento (CE) n.º 765/2006 do Conselho (os “Regulamentos”).
O fornecedor deverá facultar à Wieland todas as informações relativas ao cumprimento por parte do fornecedor das disposições constantes dos Regulamentos, conforme razoavelmente solicitado pela Wieland, nomeadamente: a) caso a sede estatutária do fornecedor se encontrar localizada fora da União Europeia, o fornecedor deverá fornecer à Wieland provas escritas de que não existem produtos de ferro e aço que estejam a ser utilizados no fabrico de produtos a fornecer à Wieland de acordo com o artigo 3g, parágrafo 1 e Anexo XVII do Regulamento (UE) n.º 833/2014 do Conselho, bem como com o artigo 1q e Anexo XII do Regulamento (CE) n.º 765/2006 do Conselho e b) o fornecedor deve facultar à Wieland provas escritas de que não importa, exporta ou inclui nesses produtos quaisquer produtos que contenham alumínio, cobre ou níquel que sejam de origem russa ou bielorrussa.
Se o fornecedor violar qualquer obrigação estabelecida nesta cláusula, a Wieland poderá resolver, com efeitos imediatos, o acordo em apreço e/ou qualquer outro acordo(s) com o fornecedor em causa.
